Private Foundation, Trust and Curacao Profit tax

A lot of Curacao real estate is being owned by private foundations (Stichting Particulier Fonds). Also other assets of course can be held by a private foundaton.



Please beware of the fact that from fiscal year 2019 on all Curacao private foundations need to file a tax return for the Curacao profit tax. This does not mean that profit tax is due but there is now an obligation to file. This of course makes that financials -starting with fiscal year 2019- do need to be drafted on the basis of which the tax return can be drafted and filed.

This means that a preliminary profit tax return needs to be filed before April 1st, 2020 and a final one before July 1st, 2020. If you avail yourself of the services of a professional tax lawyer of consultant the final tax return may be filed before end of the year 2020 but you do need to inform your tax professional thus enabling him/her to file for an extension.

Same goes for the trust which was introduced in our law system in 2012.
