A word of warning

Monday September 23rd in Antilliaans Dagblad an article on policy on substance from our Minister of Finance.

What is this all about?

In international tax planning one aims to move income from high taxed jurisdictions to low tax jurisdictions. From tax infernos to tax havens so to say.

Curacao has since the early 50's of the former century been a tax haven or offshore jurisdiction.

From 1993 on a plan was devised to shed of this offshore reputation which found its conclusion in the coming of force of the so-called New Fiscal Framework per January 1st, 2002.

Before that we had an interesting system for taxation of offshore companies. Via so-called Guarantee Ordinances it was deemed that -generally speaking- offshore income would be taxed at 10 percent of the normal rate.

At the time of  introduction of this legislation the profit tax rate was 24 percent for the first ANG 100,000.-- profit and 30 percent on the balance.

So for offshore this basically became 2,4 percent and 3 percent on the balance.

The New Fiscal Framework made an end to all that. The last Guarantee Ordinance was not to be renewed.

And that is one of the reasons why Curacao is in a perfect storm right now as the Guarantee Ordinance and the lease of the refinery to PdVSA both end this year. This of course apart from the current US restrictions on Venezuela which already make that no crude oil is being delivered to the refinery.

Curacao has created new interesting possibilities to attract other fiscal driven tax planning such as the private foundation and the tax exempt corporation, the latter now called the Curacao Investment Company ("CIC"). Private foundations are bit like a trust and CIC's are exempt from profit tax as long as they adhere to a very limited set of goals and actual activities.

Alas, Europe frowns upon this so now our Minister of Finance has published a policy on substance so that certain kind of legal entities are to benefit.


However, remember where we started. We go from high tax jurisdictions to low tax jurisdictions. The high tax jurisdiction see possible taxable income slip away to the low tax countries.

They will judge for themselves if they deem the substance on Curacao sufficient to allow taxable income to be taxed elsewhere. In other words; the policy as published by our Minister can only be relied upon for Curacao purposes. It will not reflect on the stance to be taken by any foreign tax authority in the world.

So, adhering to this policy is beneficial from a Curacao perspective but may be not so much from the perspective of that other high tax jurisdiction which taxation one tries to avoid.

Vorbeugung von Doppelbesteuerung auf Curacao


In steuerlicher Hinsicht mangelt es auf Curacao erheblich an Doppelbesteuerungsabkommen mit anderen Staaten.
Aufgrund dessen versuchen wir schon seit vielen Jahren unserer Regierung davon zu überzeugen, einseitig seitens Curacao eine Steuerpolitik einzuschlagen, die in Fällen von Doppelbesteuerung eine Steuererleichterung oder Steuerbefreiung auf Curacao zur Folge hat.
Vorschläge zur Umsetzung lagen vor, wurden aber nie ins Parlament eingebracht.

Diesen Problem hat sich nun die Judikative angenommen und eine spektakuläre Entscheidung verkündet, die bei Erlangung der Rechtskraft beste Voraussetzungen dafür schaffen könnte, dass weitere Investoren nach Curacao kommen und neue Investitionen zu erwarten sind.




Der Sachverhalt:

Ein Einwohner von Curacao erbrachte Leistungen in den Vereinigten Staaten und erzielte daraus ein dortiges Einkommen. Dementsprechend war dieser zur Abgabe einer Steuererklärung in den USA und zur dortigen Steuerzahlung verpflichtet.
In seiner nachfolgenden Steuererklärung auf Curacao bat der Steuerpflichtige um Steuererleichterung für das bereits in den USA versteuerte Einkommen. Eine derartige Erleichterung wurde abgelehnt und das Einkommen ungeachtet der darauf bereits in den USA gezahlten Steuer nochmals voll steuerlich veranlagt. Hiergegen wandte sich der Steuerpflichtige, welches zur Entscheidung des Finanzgerichtes führte.

Die Entscheidung:

Der Klägervertreter bezog sich in dessen Begründung auf eine von unserer Kanzlei in 2015 ebenfalls vor dem Finanzgericht aufgestellte Behauptung, wonach eine nicht öffentlich gemachte (interne) Richtlinie der Steuerbehörden von Curacao besteht, die derartige Erleichterungen vorsieht. Damals wurde dies durch die Steuerbehörden nicht bestritten, so dass das Gericht bereits in 2015 zugunsten des Steuerpflichtigen entschied.

Auch im nunmehrigen Verfahren entschied dem folgend das Finanzgericht, dass aufgrund dieser internen und nicht veröffentlichten Vorgaben und Politik der Steuerbehörden auf Curacao  auch die Steuerpflichtigen sich hierauf berufen und hiervon Gebrauch machen können.
Das Gericht wies darauf hin, dass das OECD Mustersteuerabkommen zu beachten und maßgeblich wäre.


Résumé:

Dieses Urteil ist sehr interessant und zugleich auch gewagt, da es sich auf nicht veröffentlichte interne Auffassungen der Steuerbehörden abstellt.

Allerdings bleibt abzuwarten, ob dieses Bestand hat und in Rechtskraft erwächst, da die Steuerbehörden bis zum 16. Oktober 2019 gegen dieses Urteil Berufung einlegen kann.

Bei Bestand des Urteiles wäre es naheliegend, in Fällen, in denen es zu Doppelbesteuerung kommt, unter Berufung auf das OECD – Musterabkommen eine Steuererleichterung auf Curacao zu beantragen.

Ich hege also die dringende Hoffnung, dass zur Klärung dieser Problematik und zur Herbeiführung einer gewissen Rechtssicherheit das Urteil Bestand hat, zumal es Curacao dann auch in wirtschaftlicher Hinsicht für Investoren  interessanter machen dürfte.

Curacao policy on prevention of double taxation

Curacao has an enormous lack in treaties on double taxation. For many years we have tried to convince our government that we should draft a unilateral policy where Curacao would provide for tax relief in cases where otherwise double taxation would occur. Drafts were made but never presented to our parliament. It seems that a judge has now created a unilateral policy via a verdict.

This is actually spectacular good news and may bring a lot of investments and investors to Curacao.

This is what happened:

A Curacao resident received income for work executed in the United States. On that income federal tax was paid upon filing of his US tax return.
On his Curacao income tax return he asked for relief as his income was already taxed in the United States. The Curacao tax inspector however gave no relief to which he objected.

His objection was denied by the tax inspector so he took his case to the tax court.

His case was represented by a lawyer. This lawyer made reference to a case that was brought to the Curacao tax court in 2015.

That case we know quite well as I was the lawyer who took that case to the court.

I made the case in 2015 that there is unpublished policy from the tax authorities addressing these kind of situations.

I could substantiate this by showing emails from the tax inspector making reference to this policy.

As a consequence the tax inspector in this 2015 case did not deny the existence of such policy so the court ruled in favour of our client.

In this year's case the tax inspector strangely enough never appeared in court in and never made a case against tax relief.

So it was now judged that there is indeed unpublished policy in place and taxpayers can avail themselves of this policy.

The judge even took it one step further by stating as we have this policy we need to adhere to the OECD Model Tax Convention for further elaboration of the prevention of relief from double taxation.

There is a unpublished policy which nobody outside the tax authorities has obviously ever seen and this judge now builds a complete theory on how to deal with these situations based on OECD policy. It is a very interesting and daring verdict indeed.

And I am elated about the outcome of this court case. The tax inspector may of course appeal the outcome of this case but they must do so before October 16 2019.

The current situation is however that when it comes to double taxation it seems that we can now use the OECD Model Tax Convention to prevent double taxation.

Based on the verdict at hand I would like to make the case that the whole OECD Model Tax Convention now forms part of our tax legislation. If the tax inspector however appeals and wins then we are back to where we were. Let us therefore hope that this verdict stands thus preventing a lot of uncertainty for persons and companies with double taxation issues. From an economic perspective it definitely good news.

Landsverordening belastingmaatregelen 2019


Wat gaat er veranderen? Wij zullen dat hieronder kort voor u aangeven.

1 Onroerendezaaksbelasting

Als eerste zijn de formele bepalingen voor de heffing van onroerendezaaksbelasting aangescherpt. Het komt er op neer dat indien u een onroerende zaak aanschaft of een beperkt recht op een onroerende zaak (zoals het recht van erfpacht) heeft u binnen twee maanden aangifte dient te doen bij de inspectie. U dient dan uw naan op te geven en cribnummer, datum van verkrijging, het adres van de onroerende zaak en u dient een schatting te geven van de waarde. Ook indien u reeds een onroerende zaak bezit maar geen aanslag heeft ontvangen dient u binnen 12 maanden na afloop van het belastingjaar (dat is dus uiterlijk 31 december) dient u een dergelijke aangifte te doen.

Als u dat allemaal niet doet mag de belastingdienst u een boete van maximaal 100 procent van het bedrag van de aanslag opleggen.

2 Omzetbelasting
 Ondernemers die handelsgoederen invoeren dienen over die ingevoerde goederen 9 procent omzetbelasting te betalen aan de ontvanger. De helft daarvan kan de ondernemer terugkrijgen. Daarvoor moet hij dan een verzoek doen waarop door de belastingdienst bij een voor bezwaar vatbare beschikking wordt beslist.

Teruggave kan echter pas aan de orde zijn als het ingevoerde goed als gevolg van een voor de omzetbelasting belaste levering of dient het bedrijfsvermogen van de ondernemer verlaat.

Indien dat allemaal geregeld is en u zoveel heeft ingevoerd dat zou moeten terugontvangen wordt dat bedrag doorgeschoven naar de volgende maand.

De kleine ondernemersregeling is niet van toepassing op degenen die een vermogensbestanddeel exploiteert om er duurzaam opbrengst uit te verkrijgen en teven niet voor degenen die werkzaam zijn in -kort gezegd- de gokwereld. Het is goed om op te merken dat de kleine ondernemersregeling alleen geldt voor natuurlijke personen.

3 Afvalstoffenheffing

De tarieven voor afvalstoffenheffing worden fors verhoogd.

4 Accijnzen

De accijnzen op wijn, bier, gedistilleerd worden ook verhoogd evenals voor sigaretten.

Als laatste is er een kleine wijziging in de innovatiebox van artikel 8a Landsverordening op de winstbelasting 1940.

Dit zijn in grote lijnen de wijzigingen die op 1 september 2019 in werking zijn getreden

Und wenn Sie keine Veranlagung fuer die Immobiliensteuer bekommen brauchen innerhalf 12 Monate nach dem Jahresende auch selber dafuer eine Anzeige beim Steueramt ein zu tragen.
